Checking a Title Deed Before You Buy: Six Points You Cannot Skip

Checking a Title Deed Before You Buy: Six Points You Cannot Skip

What to verify in a Saudi title deed before paying a deposit — ownership, area, boundaries, mortgages, land classification and disputes.

Paying a deposit is the point after which retreating costs money. Every minute spent checking the deed before that moment saves you the risk of weeks of delay or a real financial loss.

1. The owner's name on the deed

Confirm that the person negotiating with you is the registered owner, or an agent holding a valid power of attorney that specifically authorises selling — not an old general authorisation or a management mandate that does not cover disposal. Check the date and scope; a great deal of delay begins here.

2. Area and boundaries

Compare the area stated on the deed with the plan and with reality. Area discrepancies are not a formality — a single square metre carries real value in higher-priced districts. Verify all four boundaries and their lengths, especially for land.

3. Mortgages and restrictions

A property mortgaged to a lender cannot be transferred before the mortgage is released. That does not mean refusing the deal; it means structuring it correctly, with the outstanding balance settled within the sale process in coordination with the lender. What matters is knowing before you agree, not after.

4. Land classification and permitted use

Permitted use — residential, commercial or mixed — changes both the value and what you can do with the property. Buying land intending to build a shop and then discovering it is classified purely residential means you have bought something other than what you wanted.

5. Does the building match the permit?

If the land carries a structure, check it against the building permit. Violations can lead to fines or enforced modification, and those consequences pass to the new owner.

6. Existing disputes

Ask directly whether any dispute or claim exists over the property or among heirs. Inherited property in particular requires verification of the inheritance certificate and the consent of all heirs. A sale agreed by five of six heirs is not a completed sale.

A general rule

Never pay a cash deposit without a written document stating the amount, a precise description of the property, the agreed deadline for completing the deal, and what happens to the deposit if either party withdraws. A deposit without documentation is a risky gift.

Good due diligence does not kill good deals; it protects them. A deal that collapses over one question would have collapsed later at a higher cost.

Common questions on this topic

Can I buy a mortgaged property?

Yes, provided it is structured correctly: the outstanding mortgage balance is settled within the sale process, in coordination with the lender, before the electronic transfer completes.

What if the property is inherited?

Verify the inheritance certificate and ensure all heirs consent, or that whoever signs holds a valid power of attorney on their behalf.
